Jordan and Issa Drop the Mic on Rogue Judges and Nationwide Injunctions

One unelected judge. One friendly lawsuit. Nationwide policy—blocked.

That’s not democracy. That’s not due process. That’s what Reps. Jim Jordan (R-OH) and Darrell Issa (R-CA) call a full-blown constitutional crisis—and they’re not just sounding the alarm. They’re hauling Congress and the courts into the fight.

In their June 9 op-ed for The Hill, the two Judiciary Committee leaders lit up the federal bench for abusing nationwide injunctions—a judicial tactic that’s gone from rare exception to full-on political weapon.

They say the trend is clear: liberal activists file in handpicked courts, draw activist judges, and one ruling later—boom—Trump’s entire agenda is paralyzed.

Legal Anarchy in a Robe

Jordan and Issa aren’t exaggerating. In just the first few months of Trump’s second term, more than 40 nationwide injunctions have already been issued against him—stacked on top of 64 from his first term, which alone made up the majority of all such rulings in U.S. history.

“Often filed by liberal activists before sympathetic judges in carefully selected jurisdictions, a nationwide injunction enjoins conduct across the entire country.”

These aren’t narrow legal decisions. They’re sweeping overrides of the presidency—issued by judges that nobody elected and applied to Americans who were never part of the case.

And as Jordan and Issa point out, the Constitution doesn’t authorize it:

“Nationwide injunctions have no basis in American legal traditions or English common law. They violate principles of judicial restraint. And their increased use has serious consequences for constitutional order.”

The Constitution Says “Case,” Not “Country”

The judicial power was meant to settle “cases” and “controversies.” But these rulings aren’t targeted—they’re nationwide vetoes handed down from unelected judges, often rushed and rarely based on full evidence.

“Judges shouldn’t be issuing decisions that constrain people who never even set foot in the courtroom.”

And it’s more than theory. These rulings distort justice in real-time. One activist win can paralyze a national policy, while the government has to defend itself in every court, every time, against every version of the same attack. It’s an unfair playing field with a rigged scoreboard.

Congress Has Acted—Now It’s the Court’s Turn

Jordan and Issa aren’t just shouting from the rafters—they’ve taken action. The House passed a bill authored by Issa to restrict nationwide injunctions. They’ve conducted hearings. They’ve leaned on the judiciary using appropriations pressure. And they’re not done. Now they’re calling out the institution across the street: the Supreme Court.

The Court just heard arguments in an immigration case that gives it a chance to end the madness and slap the gavel back into its constitutional lane. They reference Chief Justice John Roberts’ own baseball analogy:

“A nationwide injunction would mean that an umpire’s ball-and-strike call in Cleveland would apply to the game in San Diego, in Houston, and everywhere else.”

Jordan and Issa say that logic doesn’t fly in baseball—and it sure shouldn’t fly in a courtroom.

This Is About Who Runs the Country

In closing, they bring it home:

“We are blessed to live in a democracy where the policy decisions are made by those elected to office — not by unaccountable bureaucrats or unelected judges.”

They’re right. The American people elected Donald J. Trump—not a federal judge in San Francisco.
77 million votes shouldn’t be overruled by 677 black robes.

Congress has drawn the line. Now it’s time for the Supreme Court to defend it.

Final Word

This isn’t just a battle for balance between branches of government. It’s a battle over whether we still believe in government by the people—or rule by judicial fiat.

Congress has acted. The president was elected. The people’s voice is on record. And now the responsibility lies with the Court: Will they restrain the bench, or redefine it as the new throne?

Scripture reminds us that no ruler, judge, or court stands outside of God’s reach:

“The king’s heart is a stream of water in the hand of the Lord; he turns it wherever he will.” (Proverbs 21:1)

True justice will only flow when those in power remember whose hand holds the stream.
